Opponents of a controversial sports complex in San Rafael have filed a lawsuit to block the project, claiming violations of environmental and zoning laws.
The Gallinas Creek Defense Council, a group of residents and organizations in the area, filed the suit against San Rafael, the City Council and the project applicant, San Rafael Airport, LLC.
The project was approved — after about six years of planning and public hearings — by a 3-1 vote of the City Council on Dec. 17. The plan includes a 86,000-square-foot building for soccer and gymnastics, plus a lighted outdoor turf field and another outdoor turf field, on a 9.1-acre site near Gallinas Creek, the airport and McInnis Park.
The lawsuit claims the environment impact report approved by the City Council contained "gaping holes," including insufficient analysis of the potential effects on noise levels, airplane safety, light emissions and the California Clapper Rail, a federally protected endangered species.
The plaintiffs also claim the project contradicts wetland-protection provisions in the city's general plan.
The lawsuit, filed in Marin Superior Court, asks the court to vacate the city's approval of the EIR and the project itself. It also asks the court for an injunction barring work on the complex until it is in compliance with the California Environmental Quality Act.
The suit was assigned Monday to Judge Paul Haakenson. Hearing dates are pending.
City
Manager Nancy Mackle said officials had not been served with the lawsuit and had no response.Bob Herbst, manager of the airport, said he was "obviously disappointed" by the legal action but confident the city's approval would be upheld.
"The lawsuit claims more study is needed, which frankly is ludicrous," he said in an email. "Our kids and families desperately need these sports fields, and we are committed to fight as long and as hard as necessary to get them built."
